Below is the contractual document governing the purchase of products through the website https://soniafolache.com/, owned by Sonia Folache (hereinafter, the “Provider”).
Once the commercial transaction is completed, and in accordance with Article 5 of Spanish Law 7/1998 of 13 April on General Contracting Conditions, once the user confirms the transaction after receiving the purchase confirmation containing the terms that regulate it, the user shall be deemed to have accepted the content of this document.

Acceptance of this document implies that the user:

A. Has read, understands, and accepts the provisions contained herein.
B. Is a person with sufficient legal capacity to contract.
C. Assumes all obligations set out in this document.

These terms and conditions shall remain valid indefinitely and apply to all purchases made through the Provider’s website.

The Provider reserves the right to unilaterally modify these terms and conditions at any time, without affecting goods and/or promotions previously purchased by the user before any modification.

 

IDENTIFICATION OF THE PARTIES

On one side, the Provider or supplier of the goods offered to the user: Sonia Folache.
On the other, the user, who browses the website and uses the purchasing services made available by the Provider.

 

PURPOSE OF THE CONTRACT AND GENERAL CONDITIONS

The purpose of this contract is to regulate the contractual relationship of sale arising between the Provider and the user when the user purchases a product through the Provider’s website in accordance with these conditions.

The contractual relationship of sale implies the delivery of the product displayed on the website by the Provider in exchange for a publicly listed price paid by the user.

The Provider reserves the right to refuse service to any user for any reason and at any time. The user agrees not to reproduce, duplicate, copy, sell, resell, or exploit any of the products offered by the Provider on the website without express written permission.

The Provider shall not be liable if the information on the website is not accurate, complete, or current, although reasonable efforts will be made to keep all content updated and corrected.
Every effort has been made to display the colors and images of the products as accurately as possible. However, for technical reasons, the Provider cannot guarantee that any color displayed on the user’s device screen will be exact.

The Provider reserves the right to limit the sales of products to any person, geographic region, or jurisdiction. This right may be exercised when necessary for legal or operational reasons.
The Provider also reserves the right to limit the quantities of any products offered. Product descriptions and prices are subject to change at any time without prior notice. The Provider may withdraw any product at any time. Any offer made on this site is void where prohibited by law.

 

PRODUCT PURCHASE PROCEDURE

The user may acquire products offered by the Provider through the various sections of the website. Within each section, the user will find products displayed with a main image, name, price, and available colors/materials. Hovering over the product image will show contextual photographs.

Clicking on the product image, name, or price will take the user to the product page, where enlarged images, a description, and related/recommended items will appear. On this page, the user may select color, material, size, quantity, and other product-specific options before adding it to the cart or using the Buy Now option, which leads directly to checkout.

Once all desired products are in the cart, the user can access it via the upper-right corner. The cart displays all items added, allows adjusting quantities or removing items, and shows the subtotal and shipping costs (if applicable). A Checkout button leads to the payment page.

At checkout, the user will find:

• Summary of products
• Item prices
• Shipping costs
• Total price

The user must complete the contact and delivery form with:

• Email address
• Phone number
• Full name
• Country
• Delivery address

Below, the user may choose the available shipping method and payment method.
Before payment, the user must confirm the billing address and tick the box stating they have read the Terms of Use and Terms & Conditions. Payment options remain locked until this checkbox is selected.

If the user detects an error before confirming payment, they may modify or delete items using the corresponding button. If an error is detected after payment, the user must immediately contact customer service at info@soniafolache.com. Once the order has been processed and shipped, modifications cannot be made, without prejudice to the right of withdrawal.

After completing the purchase, the Provider will confirm all order details—features, price, transport method, date of purchase, and estimated delivery—via email.

 

PAYMENT METHODS

The Provider offers the following payment methods:

  • Cards: VISA, AMEX, Maestro, Mastercard, Union Pay

Regardless of the payment method chosen, the user will receive an email confirming the order. The order details will be stored in the user’s personal account.

 

PRICE AND VALIDITY

The prices applicable to each product are those displayed on the website. The user acknowledges that the value of some products may vary in real time. Any such modification will always be communicated to users beforehand.

All payments made to the Provider will generate a receipt issued in the name of the registered user and sent automatically to the email provided.

SERVICE MODIFICATIONS AND PRICES

Product prices may change without prior notice. The Provider reserves the right to modify or discontinue the sale of any product at any time. The Provider shall not be liable for such modifications, price changes, stock shortages, or service interruptions.

Products on the website are subject to stock availability; restocks are not guaranteed.
The Provider may limit sales to any person, region, or jurisdiction and limit purchase quantities. Product descriptions and images may also change at any time.

If the Provider modifies or cancels an order, the user will be notified via email, phone, or the contact method provided.

 

ACCURACY OF INFORMATION

The user agrees to provide current, complete, and accurate information (payment, shipping, contact, etc.) and to update any changes. The Provider is not responsible for errors in information provided by the user or resulting issues such as incorrect deliveries.

SHIPPING POLICY

The Provider ships products through contracted courier companies, with appropriate data-processing agreements in place. Data is shared strictly for the purpose of delivering purchased products.

Delivery times and shipping costs:

  1. Spain (Peninsula): 3–5 days → Free
  2. Balearic Islands: 3–8 days → €15
  3. Portugal: 3–8 days → €15
  4. European Union: 3–10 days:
    a. Germany, Austria, Belgium, France, Netherlands, Hungary, Italy, Poland, Czech Republic → €20
    b. Slovakia, Slovenia, Estonia, Ireland, Latvia, Lithuania → €25
    c. Bulgaria, Croatia, Denmark → €30
    d. Bosnia, Finland, Greece, Luxembourg, Romania, Serbia, Sweden → €35
    e. Iceland → €55
    f. Norway → €65 + customs/import fees
    g. Switzerland → €65 + customs/import fees

Once the order is shipped, users receive tracking information via email.

Deliveries are made to the address provided. The Provider is not responsible for issues caused by incorrect, incomplete, or false user information.

Additional information:

Order Processing
• Orders are processed Monday to Friday until 13:00.
• Orders placed after this time ship the next business day.
• Weekend/holiday orders process the next business day.

Customs and Additional Costs
• International orders may incur customs fees, duties, or taxes, to be paid by the customer.
• The Provider is not responsible for customs delays.

Tracking
Users will receive a tracking number once the order ships.

Delivery Incidents
• The Provider will inform the user promptly of any issue.
• The Provider is not liable for delays caused by strikes, weather, or courier issues.

 

RETURNS & EXCHANGES

The Provider offers a return policy within 30 days after receiving the order, in the following cases:

A) Wrong Item Shipped

If the Provider sends the wrong item, the correct one will be shipped as soon as possible.
If the error is due to incorrect user data, the return will not be accepted.

B) Defective or Damaged Products

The user must contact info@soniafolache.com as soon as possible.
Returns will not be accepted for items on sale or purchased with gift cards, without prejudice to the right of withdrawal.

If the item is defective, the user may choose:
Refund (full reimbursement), or
Replacement (with the same product type and quality)

Replacements will be handled as soon as possible, and always within 30 natural days from user notification.

The Provider is not responsible for defects caused by external factors, force majeure, or accidents.

Conditions for Returns (all reasons):

• Must be requested within 14 natural days from receipt.
• Must include labels, packaging, and be in original condition.
• Must include receipt or proof of purchase.
• Must be shipped securely by courier.

After receiving and approving the return, the Provider will refund the product price within 10 business days via the original payment method.
Shipping costs are not refunded unless the error is attributable to the Provider.
Sale items will be refunded at the price paid, not current price.

Exchange Policy

The Provider also offers exchanges under the same conditions as returns.

 

RIGHT OF WITHDRAWAL (EU Consumers)

EU consumers may exercise the right of withdrawal within 14 natural days, without providing any reason.
The Provider will refund the amount paid (excluding shipping costs), without undue delay, but may withhold reimbursement until receiving the returned goods.

The user must notify withdrawal at info@soniafolache.com and send the product within 14 natural days.

Products must arrive in perfect condition with original packaging.
The Provider is not responsible for damage or loss during return shipping.

Exceptions to Withdrawal (Article 103 RDL 1/2007)

The right does not apply to:

• Fully performed services with prior consent
• Products with market-dependent price fluctuations
• Personalized goods
• Perishables
• Sealed goods opened after delivery
• Goods mixed inseparably with others
• Alcoholic beverages delivered after 30 days
• Urgent repair/maintenance services
• Newspapers or magazines (except subscriptions)
• Public auction purchases
• Accommodation, transport, car rental, catering, leisure activities with fixed dates
• Digital content not supplied on a physical medium once execution begins with user consent

If a product falls under any exception, withdrawal does not apply.

 

LIMITATION OF LIABILITY

The Provider does not guarantee uninterrupted or error-free website operation. Temporary outages or maintenance may interrupt sales. The Provider may cease its activity at any time and remove products from sale.

 

WARRANTIES

In accordance with Royal Legislative Decree 1/2007, products offered on this site do not include post-sale warranties, as they are not digital-content carriers.

 

APPLICABLE LAW AND JURISDICTION

These conditions are governed by Spanish law.
For any dispute, the parties submit to the courts of the user’s domicile.

If the user resides outside Spain, disputes shall be submitted to the courts of Madrid, Spain.
